1. Description of Service

KINO is an AI-powered video generation platform that allows users to create videos from text prompts and images. The Service includes features such as text-to-video generation, image-to-video animation, brand studio, camera presets, and project editing tools.

2. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

You must be at least 18 years old to create an account and use the Service.

3. Credits and Payments

Credits System

Video generation on KINO uses a credit-based system. Each video generation consumes credits from your account. Credits are deducted when a generation job is submitted and are non-refundable once used.

Subscriptions

Pro subscriptions are billed monthly or annually. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings.

Credit Purchases

Additional credits may be purchased separately. All credit purchases are final and non-refundable except as described in our Refund Policy.

4. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Create content that infringes on intellectual property rights of others
• Generate deepfakes or misleading content intended to deceive
• Produce content depicting minors in any inappropriate context
• Create content that violates any applicable laws or regulations
• Attempt to bypass content safety filters or restrictions
• Use the Service for spam, phishing, or other malicious activities
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Resell or redistribute access to the Service without authorization

5. Content Ownership

Your Content

You retain ownership of the prompts, images, and other content you provide to the Service ("Input Content"). You grant us a limited license to use your Input Content solely for the purpose of providing the Service to you.

Generated Content

Subject to your compliance with these Terms and applicable subscription terms, you own the videos and other content generated through the Service ("Output Content"). You may use Output Content for personal and commercial purposes.

Free Tier Watermarks

Videos generated on the free tier include a KINO watermark. Pro subscribers receive watermark-free videos.

6. Intellectual Property

The Service, including its design, features, and content (excluding user-generated content), is owned by Kino Labs and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

7. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Third-Party Services

The Service may integrate with or rely on third-party services, including AI models and cloud infrastructure. We are not responsible for the availability, accuracy, or policies of third-party services.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

AI-generated content may not always meet your expectations or requirements. We do not guarantee specific results from using the Service.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINO LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Kino Labs and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

12. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website or through the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

14. Governing Law

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
