DMCA Policy

Kino Labs ("KINO," "we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. This policy outlines our procedures for responding to claims of copyright infringement in accordance with the Digital Millennium Copyright Act (DMCA).
1. Reporting Copyright Infringement
If you believe that content on KINO infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include:
- A physical or electronic signature of the copyright owner or authorized representative
- Identification of the copyrighted work claimed to be infringed
- Identification of the infringing material and information sufficient to locate it (e.g., URL or description)
- Your contact information (name, address, phone number, and email)
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner

3. Processing of Notices
Upon receiving a valid DMCA notice, we will:
- Remove or disable access to the allegedly infringing content
- Notify the user who posted the content about the takedown
- Provide the user with information about filing a counter-notice
4. Counter-Notification
If you believe your content was removed in error, you may submit a counter-notification. Your counter-notice must include:
- Your physical or electronic signature
- Identification of the removed content and its prior location
- A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification
- Your name, address, and phone number
- A statement consenting to jurisdiction of the federal court in your district (or Delaware if outside the US)
- A statement that you will accept service of process from the complainant

5. Counter-Notice Processing
Upon receiving a valid counter-notice, we will:
- Forward a copy to the original complainant
- Inform them that we will restore the content in 10-14 business days
- Restore the content unless the complainant files a court action
6. Repeat Infringers
We maintain a policy of terminating accounts of users who are repeat copyright infringers. Users who receive multiple valid DMCA notices may have their accounts suspended or permanently terminated.
7. AI-Generated Content
KINO is an AI-powered platform. While users provide prompts and input images, the AI generates video content. We take the following approach to copyright concerns:
- Input Images: Users are responsible for ensuring they have rights to any images they upload
- Prompts: Users should not request content that intentionally copies copyrighted works
- Generated Content: AI-generated content may inadvertently resemble existing works; we will respond to valid takedown notices
8. Good Faith Requirement
Under the DMCA, anyone who knowingly misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. Please ensure your notices and counter-notices are accurate before submitting.
9. Non-US Copyright Claims
While this policy focuses on US DMCA procedures, we respect intellectual property rights internationally. If you are outside the US and have a copyright concern, please contact us at dmca@kinolabs.ai with details of your claim.
